william.maggos
You're being lied to about the #H1B visa being necessary to hire the exceptional person that there are maybe only a few of in the whole world. Einsteins. The only people who can figure out the next needed innovations who they say without which, entire industries would come to a halt. There are separate visas for that.

https://en.wikipedia.org/wiki/EB-1_visa

https://en.wikipedia.org/wiki/O_visa

william.maggos
One #H1B argument is that they have to look outside of the US because they just can't find the right combination of skills here. Well then doesn't supply and demand argue that the employer who needs to do that should be willing to pay multiple times what they'd pay a similar but not exactly skilled person in America? They need the only person/people who can do the job in the whole world. They must be worth millions. Or you could train up your current staff or an American.

Adrianna Tan
I have a hot take that ultimately a lot of the kerfuffle about immigration *everywhere* is about the growing class and wage disparity of tech money and other jobs.

Across the world, people who work in tech hubs: have similar profiles, backgrounds, education, experience, and a lot more mobility than most others.

Every country’s ‘native’ population that feels left out and ignored and neglected by their own situation, finds it easy to blame the ‘foreign elite’, when it’s their own elites messing them up too.

I said it a few days ago: a software developer from Bangalore or Singapore or London or Berlin has a shorter cultural and professional distance to traverse to Silicon Valley or New York jobs and money, than someone from Fresno or Salinas. What more someone from a totally different state.

The visa gets them in, and there is some exploitation (in other ways than wages); but they aren’t the reason why ‘Americans’ aren’t getting these jobs. They’re the symptom, not the cause.

#Immigration #H1B

Adrianna Tan
If you’ve ever applied for a #H1B visa, you’ll know that there is a publicly searchable database with the Dept of Labor that, based on your occupation and location, determines the salary floor at which your visa will be approved.

That also means, unlike people here who are spreading lies about H1B salaries, and wage slavery, you’ll be simply befuddled at the supposed terrible wages you’re receiving.

There are other exploitation problems here, but people who keep pushing this narrative aren’t helping anyone. (This is base comp and excludes stocks. DOL doesn’t care about stocks, but needs your base comp to exceed these numbers)

#Immigration

Adrianna Tan
I don't care about your political beliefs: if your plan for 'improving legal immigration' is 'restricting the H-1B cap' and restricting rights of immigrants, instead of advocating for their rights and against employers, you are not a good ally.

You are an unsafe person who is okay with causing great harm to Americans and immigrants alike, who has fallen for a nativist lie.

#H1B #Immigration

Ben Toh
NB: Let's say you are in the US via a student visa. You are not allowed to tell the government that you intend to immigrate to the US. If for some reason you tell them you would try to stay on in the US (say you apply for green card), you will not be allowed to enter the states next time you flying in from other countries.

#H1B allows you to have immigration intention, since, well the US do want specialists, professionals, scientists and whatnot to eventually stay on right? (9/12)

Ben Toh
3. No rules restricting #H1B folks to join unions; the company can retaliate and fire you I guess, in which case you have 60 days to find another company to take you in or you have to leave US.
4. Nope, you can't work for someone else; so you can't drive for Uber at night, for example...
5. Yeah I think US can revoke your H1B if you conduct crime lol (8/12)

Ben Toh
Soooo, is #H1B worker the low-cost indentured servant that has no rights? All system is bound to be exploited, but on the book here are some of the fact(ish):
1. You cannot pay H1B workers lower wage than their peers, at least not on the book
2. H1B status is tied to the employer; but it can get transferred to another employer as long as they hire you under the same job title (7/12)

Ben Toh
Once you win the lottery, the employer would need to go on to file for the #H1B petition. This is usually when the employers pay substantial amount of money (thousands if not more?) to put together the documents, and filing fees. Employers also usually pay premium processing fees so that they can get the approval asap, you gotta act fast here... (4/12)

Ben Toh
There's only one "intake" each year, if you get it, you start your job in October that year.

This means that, yeah, companies start talking to potential foreigners whom they want to hire in say late last year, register them to the system by March. And by the end of March, the government would announce the winner of the lottery. Yes, the number of applicants is much larger than the quota, so every year about 1/3 or 1/4 of the applicants would actually "win the #H1B lottery" (3/12)

Ben Toh
The employer needs to apply for the status on your behalf, so it's kind of like: Hey US government, I need this guy who has the skills I want to come to the US and work for me, could you please grant them a #H1B?

The catch is, every year, US sets a quota of new 65000 H1B statuses to be given. And since they really want more people with advanced degree, there's another 20000 statuses reserved for folks with Master degree and above. (2/12)

Ben Toh
Seeing a lot of mention of #H1B visa status lately. Since I'm a H1B holder, I feel like perhaps I can say a thing or two about it, especially when I think a lot of US-ians may not know what exactly it is... (and yeah being called low-cost slave worker is strange)

H1B is an immigration status that, at least on the book, allows foreign skilled worker to come to the US and work. (1/12)

william.maggos
Loved this discussion of the #H1B issue that's rankling #MAGA world, but coming mostly from the left. As #BriahnaJoyGray says, what's so great about it is that it lets us talk about so much that we either haven't before, or not in this way. #IramiOseiFrimpong #QAnthonyAli #ZaidJilani
https://pca.st/episode/32b826d7-88a9-4f6f-bff5-19f3abb297e2

Adrianna Tan
There's been a lot of debate about #H1B recently. People are calling for its reform (or restriction).

On the reform front, the H-1B final rule goes into effect on 17 Jan 2025 and addresses a few key items.

1. F-1 (students) awaiting a H-1B can now get automatic work auth until April 1 the next year

2. Degree requirements modernized

3. Entrepreneurs that own US companies can get H-1Bs for themselves

4. Broadens scope of 'cap-exempt' employers (like research institutions..)

#Immigration

Adrianna Tan
Let me put it this way. If you want to restrict #H1B you are effectively saying the only people who can get green cards and citizenship are: (1) people who win a lottery (diversity lottery) (2) people who are related to citizens (family-based visas) (3) people who are married or engaged to citizens (spousal visas).

There are no other immigrant visas.

You’re saying anyone who came here to study can fuck off back where they came from unless they marry a citizen.

#Immigration
